This website, jennsmira.com (the “Site”), offers information, products, and services related to real estate (the “Services”) that Jennifer Smira Real Estate LLC, d/b/a Jenn Smira & Co., Fine Homes at Compass Real Estate (“Jenn Smira & Co.,” “we,” “us,” or “our”) provides. Jenn Smira & Co. is a team of real estate professionals affiliated with Compass, licensed as Compass Real Estate in the District of Columbia and as Compass in Virginia and Maryland (“Compass”). We may use third-party contractors to support delivery of the Services and the Site (“Service Providers”).

This Privacy Policy and Terms of Use applies to visitors of this Site and describes our practices regarding the collection, use, and disclosure of personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us solely as service providers and data processors. This Policy does not apply to other websites, applications, or online services that do not link to it, including other services provided by us, by Compass, or by our Service Providers. 1.  Personal Information We Collect

Information You Provide to Us: contact information (name, email address, home address, phone number); feedback or correspondence you send us; marketing preferences and consents; property search and transaction preferences (budget, desired locations, property type, timeline); and other information you voluntarily provide or that is necessary in connection with your interactions with us.

Information We Obtain from Third Parties: social media information from platforms such as Facebook, LinkedIn, and Instagram (the platforms’ own privacy policies apply to your interactions with them); data enrichment from third-party providers and publicly available sources, including property records, MLS data, and other public records; and other information from Compass, analytics services, marketing partners, and data providers. We do not use enrichment data, and do not permit any third party to use enrichment data obtained through us, to make or assist in making any decision regarding your eligibility for housing, credit, insurance, employment, or any other benefit for which a consumer report would be required under the federal Fair Credit Reporting Act.

CRM and Communication Data: If you communicate with us by email, text, or other electronic means, or through customer relationship management (“CRM”) tools such as Follow Up Boss, we may collect message content, headers, metadata, and attachments; call logs and recordings where permitted by law; timestamps, read receipts, and delivery status; and notes relating to our interactions with you. Our CRM may synchronize with email and phone accounts to facilitate communication management and better service.

Automatic Data Collection: We and our Service Providers may automatically log information about your computer or mobile device and your interaction with our Services over time, including device data (operating system type and version, browser type, screen resolution, device type, IP address, unique identifiers, language settings, mobile carrier, and general location such as city or state) and online activity data (pages or listings you viewed or saved, time spent on a page, browsing history, navigation paths, access times, and whether you opened or clicked links in our marketing emails). We use cookies (text files that uniquely identify your browser or store settings), local storage technologies (which provide cookie-equivalent functionality but can store larger amounts of data), and web beacons or pixel tags (used to confirm that a page or email was accessed or that certain content was viewed) to collect this information.

Chat and Messaging Features: If the Site offers live chat or an automated assistant, your conversations may be recorded and processed by us and the Service Providers operating that feature. Please do not submit sensitive personal information through a chat feature.

3.  Use of Artificial Intelligence

We use artificial intelligence (“AI”) and machine learning technologies to provide and improve our Services.

AI-Generated Content: We may use AI to generate, assist with, or enhance content displayed on the Site or provided through our Services, including property descriptions and listing information, blog posts and articles, social media and marketing materials, email communications and newsletters, and advertising copy. AI-generated content is created using large language models and other machine learning systems, and while we review it for accuracy and appropriateness, it may contain errors, omissions, or inaccuracies. You should not rely solely on AI-generated content for important decisions, including real estate transactions, without independent verification.

AI-Assisted Communications and Analysis: We may use AI to draft or suggest responses to inquiries, analyze communication patterns, and prioritize or categorize incoming messages; a member of our team typically reviews and approves AI-assisted messages before they are sent, though some automated responses may be sent without individual human review. We may also use AI to identify potential opportunities based on your stated preferences and behavior, suggest properties matching your criteria, and analyze market trends. These analyses and recommendations are informational only and are not professional, legal, or financial advice; important decisions should be made in consultation with qualified professionals. We do not use AI to make, and AI does not make, any decision that produces a legal or similarly significant effect concerning you.

Your Choices Regarding AI: You may ask us whether AI was used to generate specific content provided to you, request that a person review any significant determination made with AI assistance, and provide feedback on AI-generated content or recommendations. To exercise these rights or ask questions about our use of AI, contact us using the information in Section 14 below.

4.  How We Share Your Personal Information

We do not “sell” personal information as defined under applicable law, but we may share it with: our employees and contractors, Compass, and our other affiliates, to facilitate your interactions with us and support your transaction; our Service Providers, who provide hosting, IT, CRM, calling/texting, email and messaging delivery, AI, advertising, and analytics services on our behalf; third parties involved in your transaction, such as title companies, lenders, inspectors, attorneys, other brokerages and agents, and MLS organizations; professional advisors such as lawyers, bankers, auditors, and insurers; and, for compliance, fraud prevention, and safety purposes, as described above. We (or our Service Providers) may also share information in connection with a business transaction such as a merger, acquisition, or sale of assets, and will make reasonable efforts to require the recipient to honor this Policy. Other than as described here, we do not share data with third parties for marketing purposes. We will never disclose text messaging originator opt-in data and consent, or phone numbers, to any third party for marketing purposes, and we do not include phone numbers in any list uploaded to an advertising platform.

5.  Advertising and Tracking Technologies

We may share certain information with third-party advertising platforms, including Meta (Facebook/Instagram), Google, and other advertising networks, to deliver targeted advertisements based on your interests and interactions with our Site, measure the effectiveness of our advertising campaigns, create “lookalike” audiences of similar users, and track and attribute conversions. When you interact with our Site, these platforms may collect information through cookies, pixels, and similar technologies, including device identifiers, browsing behavior, and your interactions with our advertisements.

We also use tracking pixels (also known as web beacons or clear GIFs) to track when you view or interact with our content, measure the effectiveness of email campaigns, attribute conversions to specific campaigns, and analyze user behavior on our Site; these technologies may transmit information about the pages you visit and actions you take to third-party platforms. We participate in interest-based advertising, meaning our advertisements may appear on third-party websites and platforms based on your browsing behavior and inferred interests, using cookies and similar technologies that track your activity across different sites and services. 6.  Privacy Choices and Opt-Outs

We honor an opt-out for the browser and device on which it is submitted and, where we can reasonably associate the request with you, across your other interactions with us. Your browser or a browser extension may also be able to send an opt-out preference signal, such as Global Privacy Control (“GPC”); we treat a GPC signal received from your browser as a valid request to opt out of the sale or sharing of personal information associated with that browser and device. 7.  Your Privacy Rights

Depending on your location, you have the right to: learn how we collect and use your personal information (as described in this Policy); access a copy of your personal information in a portable, readily usable format; correct inaccurate or outdated information; delete information we no longer need; and object to or restrict certain uses, or withdraw consent where applicable. Sections 16, 17, and 18 describe the specific rights available to residents of California, other U.S. states, and the European Economic Area, the United Kingdom, and Switzerland. 8.  Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. Contact and communication records are generally kept for the duration of our relationship with you and a reasonable period after; CRM data is retained while you maintain an active relationship with us; transactional records are retained to comply with MLS, brokerage, and licensing rules; and marketing preferences are kept until updated or withdrawn. When information is no longer needed, we securely delete or anonymize it, though we may retain anonymized or aggregated data for analytics.

9.  How We Handle Requests to Delete

When we grant a deletion request, we remove the information from our systems and direct our Service Providers to do the same. We retain a record that you made the request, along with limited identifying information, so we can continue honoring it and demonstrate compliance; this record is not used for any other purpose. If you prefer we retain nothing at all, let us know and we will remove that record too. Copies in backup or disaster-recovery systems are overwritten in the ordinary course of those systems’ rotation.

10.  Third-Party Services

The Site and Services may link to websites and online services operated by third parties, including Compass and other affiliated brokerages, and our content may be integrated into pages we do not control. These links are not an endorsement of, or representation of affiliation with, any third party other than Compass. We are not responsible for the actions of third-party websites or services.

11.  Bright MLS IDX/VOW Data Feed Disclosures

Certain listing content displayed on the Site is provided through Bright MLS (“Bright”) under its Internet Data Exchange (“IDX”) and Virtual Office Website (“VOW”) programs, and the following disclosures apply to that content in accordance with Bright’s Policy on Digital Display.

IDX Content: Property listing information displayed on the Site is provided courtesy of Bright, which is the source of this content. This information is for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Some properties which appear for sale on this website may subsequently have sold, gone under contract, or been withdrawn and may no longer be available. Listing information, including square footage, is deemed reliable but is not guaranteed and should be independently verified. Each listing-detail page identifies the listing broker and agent and how to contact them, and the advertising broker for this Site is Compass, displayed prominently and in a readable color and typeface. Where a listing has been supplemented with our own photos, videos, or descriptions, we attribute the underlying data as “Property Information from Bright MLS,” and we will promptly remove any such added content at a listing broker’s request. © 2026 Bright, All Rights Reserved. VOW Access and Terms of Use: If the Site offers Virtual Office Website functionality, registered users must affirmatively agree to VOW Terms of Use before receiving access. By registering, you acknowledge a lawful consumer relationship with us as a real estate broker; agree to use VOW content solely for personal, non-commercial evaluation of real estate in which you have a bona fide interest in purchasing, selling, or leasing; agree not to copy, redistribute, or retransmit VOW content except in connection with your consideration of an individual property; acknowledge Bright’s copyright in the underlying database; and authorize Bright and other MLS participants to access the VOW as needed to verify compliance with applicable rules. These Terms of Use do not create any financial obligation or brokerage representation agreement, which if applicable will be presented separately and cannot be accepted solely by clicking through this Site. MLS listing information displayed through the VOW is deemed reliable but is not guaranteed accurate by Bright. Listings obtained from sources other than Bright are separately identified. If a listing broker notifies us that VOW content is false, we will investigate and, where warranted, correct or remove it within 48 hours; we are not obligated to remove content that reflects our good-faith opinions or professional judgment. This Privacy Policy and Terms of Use serves as the required VOW privacy policy disclosure. A seller may request that certain features, such as automated valuations, comments, or reviews associated with their listing, be disabled, and we will honor such requests for both IDX and VOW display.

Questions about listing data sourced from Bright MLS, or requests relating to IDX/VOW content, may be directed to us using the contact information in Section 14.

12.  Security and Children

We employ technical, organizational, and physical safeguards designed to protect personal information, consistent with generally accepted industry standards, both during transmission and in storage. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

The Services are not intended for use by children under 18. If we learn we have collected personal information from a child under 18 without required parental or guardian consent, we will delete it, and we do not knowingly sell or share the personal information of any consumer under 16.

13.  SMS Text Messaging Terms of Use

We use SMS text messaging to respond to inquiries, share requested property and market information, schedule and confirm showings and appointments, send reminders, and notify you of updates related to your real estate transaction.

By providing your phone number and opting in to receive text messages, you consent to receive SMS messages from Jenn Smira & Co. and its Service Providers, including messages sent using an automatic telephone dialing system. Consent is not a condition of purchasing any property or services, and message frequency will vary based on your interactions with us. Text messaging originator opt-in data and consent will never be shared with any third party for marketing or promotional purposes.

You can cancel the SMS service at any time by texting “STOP” to the number messaging you; we will confirm your unsubscription by reply, after which you will receive no further messages until you sign up again. 16.  Notice of Collection and Additional Rights for California Residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), permits you to request information, no more than once per calendar year, regarding our disclosure of your personal information to third parties for their direct marketing purposes, and provides the additional rights below.

Categories of Personal Information Collected: In the preceding 12 months, we may have collected identifiers (name, email, phone, IP address); information described in California Civil Code section 1798.80(e); protected classification characteristics (such as gender and age); commercial information (property preferences, transaction history); internet or electronic network activity; geolocation data; audio, electronic, or visual information (such as email, text, chat, or call recordings); professional or employment information, if provided; inferences drawn from the foregoing; and sensitive personal information, only if voluntarily provided (such as account credentials). We collect these categories from you directly, your device and browser, our Service Providers, Compass, social media platforms, and third-party data providers, and we use and disclose them for the purposes described in Sections 2 and 4.

Requests to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting or selling it, the categories of third parties with whom it was shared or sold, and how long it is retained. We are not required to respond to such requests more than twice in a 12-month period.

Requests to Delete or Correct: You may request that we delete or correct personal information we hold about you; we will do so upon a verified request unless otherwise authorized by law, and handle deletions as described in Section 9.

Authorized Agents: You may designate an authorized agent to submit a request on your behalf, provided you give the agent written permission and we are able to verify your identity; an agent with power of attorney under Probate Code sections 4000-4465 may also submit a request directly.

Submitting and Responding to Requests: Submit requests to know or delete by email at connect@jennsmira.com or by mail to the address in Section 14. We may ask for information to verify your identity, used only for that purpose. We will acknowledge receipt within 10 business days and respond within 45 calendar days (extendable once by up to 90 days with notice). Disclosures cover only the preceding 12 months. We do not charge a fee unless a request is excessive, repetitive, or manifestly unfounded, in which case we will explain why and provide a cost estimate first.

Non-Discrimination: You have the right not to be discriminated against for exercising these rights.

Selling and Sharing of Personal Data: We do not “sell” personal information as defined by the CCPA. We may “share” certain information (such as device identifiers and browsing activity) with advertising partners for cross-context behavioral advertising as described in Section 5. You may opt out by selecting “Do Not Sell or Share My Personal Information” in the Site footer, transmitting a Global Privacy Control signal, or contacting us. We do not knowingly sell or share personal information of consumers under 16.

Sensitive Personal Information: Some personal information may be considered sensitive under the CCPA and similar laws, such as government identification numbers, race or ethnicity, health information, sexual orientation, or union membership. We do not request sensitive personal information through the Site except account credentials used to secure your account, and we do not use or disclose sensitive personal information in a manner that triggers the CCPA “right to limit,” so we do not offer a separate limitation mechanism.

17.  Additional Rights for Residents of Other U.S. States

If you reside in a state with a comprehensive consumer privacy law, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, or Rhode Island, you may have the right, subject to your state’s law, to: confirm whether we process your personal information and access it; obtain a portable, readily usable copy; correct inaccuracies; delete information we have collected (handled as described in Section 9); opt out of processing for targeted advertising, sale, or profiling that produces legal or similarly significant effects (we do not engage in such profiling); and obtain a list of third parties to whom we have disclosed your information, where your state’s law provides that right.

To exercise these rights, contact us using the information in Section 14, or, to opt out of targeted advertising, select “Do Not Sell or Share My Personal Information” in the Site footer or transmit a Global Privacy Control signal. We honor recognized universal opt-out mechanisms where required by your state’s law.

Appeals: If we decline to act on your request, you may appeal by replying to our response or emailing connect@jennsmira.com with the subject line “Privacy Request Appeal.” We will respond in writing within the period required by your state’s law, generally 45 or 60 days, explaining our decision.
